Placing an order on the website implies prior and unreserved acceptance of these terms. The customer receives confirmation of this when validating the order.

Article 2: Products

The products offered are those shown on the website on the day of consultation, subject to availability. Our dresses are one-off pieces or produced in limited runs.

Photographs and descriptions are prepared with the greatest care. Slight variations in shade may nonetheless appear depending on the screen, without engaging the seller's liability.

Our dresses run small. We invite every customer to check her waist measurement before ordering.

Article 3: Prices

Prices are shown in euros, inclusive of all taxes, excluding delivery charges. Delivery charges are displayed before final validation of the order and repeated on the confirmation.

The seller reserves the right to change its prices at any time. Products are invoiced at the price in force at the time the order is placed.

For deliveries outside the European Union, any customs duties and local taxes remain payable by the customer and may be demanded by the local authorities on delivery.

Article 4: Orders

The customer selects the items, checks the contents of the basket, enters delivery details and validates payment. The order is firm as from that validation.

A confirmation email summarising the order is sent to the customer. The seller reserves the right to refuse or cancel any order in the event of a previous payment dispute, an abnormal order or suspected fraud.

Article 5: Means of payment

Payment is made online, at the time of the order, by:

  • bank card (Visa, Mastercard, Carte Bleue)
  • Shop Pay
  • Apple Pay

Transactions are secured by our payment provider. The seller has no access to complete banking data.

Article 6: Delivery

We deliver within mainland France, across Europe and internationally.

Outside holiday and sale periods, orders are prepared within 24 working hours. Estimated transit times are then 5 working days within mainland France, 6 to 7 working days to other European countries, and 2 days for express home delivery in France.

Delivery charges:

  • France, pickup point: €6.99
  • France, home delivery: €11.99
  • Europe, home delivery: €13.99
  • Other destinations: €25

These times are indicative and may vary in periods of high demand. If delivery has not taken place within thirty days of the order, or by the agreed date, the customer may give the seller formal notice to deliver within a reasonable additional period; failing performance, the customer may terminate the contract and obtain full reimbursement of the sums paid (articles L216-1 to L216-6 of the French Consumer Code).

Goods travel at the seller's risk. Risk passes only on physical delivery of the parcel to the customer. If a parcel is missing or damaged on receipt, the customer is invited to contact us as soon as possible at info@lapetite-robe.com, with a photograph where possible.

Article 7: Right of withdrawal

The customer has fourteen days from receipt of the order to withdraw, without having to give reasons or bear any penalty (article L221-18 of the French Consumer Code).

The full procedure — declaration, return, condition of the items, return costs, refund, exchange or credit note — is set out in our return policy, which forms an integral part of these terms.

Article 8: Legal guarantees

Independently of any commercial warranty, the seller remains bound by:

  • the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), allowing the customer to obtain the bringing of the goods into conformity, their repair, their replacement or, failing that, a price reduction or termination of the sale;
  • the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

These guarantees are exercised at no cost to the customer. Any request should be sent to info@lapetite-robe.com.

Article 9: Personal data

The data collected is necessary for processing orders and managing the customer relationship. Its processing is described in our privacy policy. The customer has rights of access, rectification, erasure, portability and objection, which may be exercised at info@lapetite-robe.com.

Article 10: Force majeure

The seller's liability cannot be engaged in the event of non-performance or delay due to force majeure within the meaning of article 1218 of the French Civil Code.

Article 11: Consumer mediation

In accordance with article L612-1 of the French Consumer Code, the customer has the right to use a consumer mediation service free of charge with a view to the amicable resolution of a dispute with the seller, having first attempted to resolve the dispute directly with us by means of a written complaint.

The mediator appointed by the seller is:

CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris, France
https://cm2c.net/

Referral to the mediator is free of charge for the consumer. It is admissible only after a written complaint has first been addressed to the seller and has not received a satisfactory solution.

Article 12: Complaints and disputes

Any complaint may be sent to info@lapetite-robe.com. We undertake to reply as promptly as possible.

These terms are governed by French law. Failing amicable settlement, the consumer customer may bring the matter, at their choice, before the court of the place where they resided at the time the contract was concluded or the damaging event occurred, or before the court of the seller's registered office.

Article 13: Amendment of the terms

The seller reserves the right to amend these terms at any time. The applicable terms are those in force on the day of the order.
